J Home Residency: Fulfilling, Waiving, and Working With the Requirement

We will briefly go over the basics of the J 212e home residency requirement and requesting Advisory Opinions from the U.S. Department of State. An immigration attorney will go over options for fulfilling the home residency requirement, remaining in the U.S. while subject, and options for waiving the home residency requirement. An experienced Responsible Officer will then lead an interactive discussion on best practices, including continuity planning for departments/organizations with Exchange Visitors; conflicts of interest for Responsible Officers when an Exchange Visitor wishes to waive their 212e requirement; a 212e requirement waiver conflicting with nonimmigrant intent for the Exchange Visitor, advising/educating Exchange Visitors on requirements and options, and working with in-house or outside immigration counsel.

  • Advise EVs on the basics of the home residency requirement.
  • Advise departments/organization in continuity planning when an EV is subject to the home residency requirement.
  • Navigate potential conflicts of interest.
